Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and BeatBuds ("BeatBuds", "we", "us"). By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use BeatBuds.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use BeatBuds. By using the app you represent that you meet this requirement and that the information you provide is accurate.

2. The service

BeatBuds pairs you in real time with another user. Each of you may recommend a song from your own whitelisted music sources; both hear a short preview, can react with emoji, and can save songs to your own music library. You can then rematch or leave. Features, limits, and availability may change over time.

3. Accounts & third-party services

You sign in using Spotify or Apple. You are responsible for activity under your account and for complying with the terms of those providers. Your use of Spotify and Apple Music content is also governed by their respective terms; BeatBuds does not grant you any rights to that content beyond what those services allow.

4. User conduct & objectionable content — zero tolerance

BeatBuds has zero tolerance for objectionable content and abusive behavior. Because you interact with other people, you agree that you will not, through any content you submit (including your display name, social link, and song recommendations) or any interaction:

Harass, bully, threaten, stalk, or abuse any other user;
Submit or share content that is hateful, sexually explicit, violent, illegal, or otherwise objectionable;
Recommend or link to content that infringes others' rights or violates any law;
Impersonate any person or misrepresent your identity;
Spam, advertise, or attempt to defraud other users;
Attempt to identify, contact, or track another user without their consent, or otherwise misuse a shared social link;
Circumvent, probe, or interfere with the app's security, rate limits, or intended operation.

Reporting and blocking. You can report or block another user from within the app. We review reports and may remove content and suspend or permanently ban users who violate these Terms — at our discretion and without notice. We aim to act on credible reports of objectionable content or abusive users promptly.

By using BeatBuds you acknowledge that there is no tolerance for objectionable content or abusive users, and that violating this section may result in immediate termination of your account.

5. Subscriptions & payments

BeatBuds offers an optional auto-renewing Premium subscription (e.g. monthly or yearly).
Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
Subscriptions renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period.
You manage and cancel your subscription in your Apple ID or Google Play account settings; deleting the app does not cancel a subscription.
Except where required by law or store policy, payments are non-refundable. Refund requests are handled by Apple or Google under their policies.

6. Advertising

The free tier is supported by ads. By using the free tier you agree to receive ads as described in our Privacy Policy. Premium removes ads.

7. Intellectual property

The BeatBuds name, app, and original content are owned by us or our licensors. Music, artwork, and previews belong to their respective rights holders and are provided through Spotify, Apple, and other sources under their terms. You receive no ownership of that content.

8. Disclaimers

BeatBuds is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, or that any match or recommendation will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, BeatBuds will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the app. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

10. Indemnification

You agree to indemnify and hold BeatBuds harmless from claims arising out of your content, your use of the app, or your violation of these Terms or the rights of others.

11. Termination

You may stop using BeatBuds and delete your account at any time (Settings → Delete account). We may suspend or terminate your access if you violate these Terms or to protect the service or other users.

12. Governing law & changes

These Terms are governed by the laws of Texas, USA, without regard to conflict-of-laws rules. We may update these Terms; material changes take effect when we post the updated version (see the "Last updated" date) and, where appropriate, give in-app notice. Continued use after changes means you accept them.
